    Dr. Yousef is highly recognised for his technical expertise that was gained from a legal practice covering a period of over 30 years in multiple jurisdictions.  Prior to joining AMJ in 2005, Dr. Yousef practiced law for 15 years in one of the leading firms in Egypt appearing before administrative courts in Egypt and Saudi Arabia. In 2009, he was appointed as an accredited arbitrator by the Egyptian Arbitration Centre.

     

    As a Partner in the Firm, Dr. Yousef heads one of AMJ’s litigation and arbitration teams.  He has built a reputation of being the go-to advocate before the Administrative Courts in Oman.

     

    Dr. Yousef advises and represents a wide range of client transactions spanning ministries, government entities, public authorities, leading corporate and institutional bodies, and private individuals before all tiers of the Omani Courts. Apart from his expertise in commercial and civil litigation and arbitration, Dr Yousef has developed a specialist niche practice in the field of Omani administrative law.  His successful track record of prosecuting and defending ground-breaking cases before Oman’s administrative court has led to Dr Yousef being consulted by the Ministry of Justice on the development of new administrative laws.

     

    Dr. Yousef has authored a number of publications on substantive law and Sharia law and delivers periodic seminars on arbitration and litigation to government and educational institutions.

  • ADMINISTRATIVE COURTS
  • Retained by the Public Authority for Stores & Food Reserve (PASFR) as Legal Counsel to represent all cases and represented PASFR in a claim filed on a food company for an amount of RO 2,257,081.
  • Retained by Public Authority for Electricity and Water (PAEW) in a suit for nullification of the Judgment issued in an Arbitration matter filed by against Septech Muscat LLC.
  • Engaged by an international law firm to act as PAEW's Omani Law Counsel
  • Representing a huge volume of private clients in claims filed on the Ministry of Municipality before the Administrative Courts.
  • Retained by the Ministry of Awqaf (the Ministry) as Legal Counsel and represented the Ministry on numerous claims filed by or against the Ministry before the Administrative Courts.
  • Cancellation of a negative administrative decision awarded 11 years earlier under the principle that there was no legal limitation.
  • Retained by a construction company in a dispute with the Diwan of the Royal Court.
  • Successfully acted on behalf a prominent private hospital in a case filed against the Ministry of Health for cancellation of their operating license and pharmacy license.
  • Successfully represented 3 labour suits filed before the Appeals Circuit of the Administrative Court against the Ministry of Health on behalf of 3 senior Doctors for being denied a promotion that was due to them. On appeal of the impugned judgment, the Appeal Court cancelled the Primary Court judgment and awarded all the 3 Doctors with a promotion as Senior Consultants.
  • Successfully represented various Ministries and Public Authorities in matters before the Administrative Courts
  • Represented a client in Dubai in a claim filed on the Ministry of Commerce & Industry before the Administrative Court for erroneously approving a trademark that infringed on the trademark granted earlier to our client.
  • Successfully acted for a leading non-banking finance company in a suit filed before the Administrative Court to prevent the borrower of a loan for more than RO 20 million from sale of his property pledged as a security to the finance company and to grant permission for the finance company to sell the mortgaged property and recover its outstanding loan from the sale proceeds.
  • COMMERCIAL COURTS
  • Represented an international client in a claim for demurrage against the owners of a ship for delays in discharging cargo at the Port of Salalah.
  • Defending a power holding company against a claim for compensation for a trademark infringement.
  • CLAIMS IN ARBITRATION
  • Acting for a Dubai based construction company in recovery claims against three private enterprises in Oman for non-compliance of the contractual obligations.
  • Defending an Omani construction company against a recovery claim for damages relating to the Seeb interchange project.
  • Acting for an Omani construction company in a claim for outstanding payments under a sub-contract.
  • Defending an Omani construction company against a claim for damages relating to the Majlis project.
  • EMPLOYMENT AND LABOUR CLAIMS
  • Acted as legal counsel for a prominent telecommunication operator in a high volume of labour claims filed by employees who were retrenched.
  • Representing a leading tourism development company in more in a number of labour claims for unfair termination.
  • Acting on behalf of various hotel companies against labour claims for promotions, salary increase, change in employment contracts and unfair termination.

  • Published a book on Research relating to employee’s entitlement to leave and rest, comparative study in 1993.
  • Published a book titled Comparative study on witness testimonies as means of evidence before the administrative court in 2004.
  • Published a book on Comparative study of the two-degree litigation in Egypt and Oman in 2012.
  • Published a book on Administrative Research in Omani Laws, Part 1 in 2012.
  • Published a book on Administrative Research in Omani Laws, Part 2 in 2014.
  • Authored a book on Research on pleading ignorance and its effect in judicial disputes, comparative study in 2014.
  • Researched and studied the limits of the administrative judge’s authority in respect to enforcing the provisions of Islamic Share’ia in Arab countries, and published a book on this topic in 2016.
  • Published several legal articles in Egyptian and Omani newspapers; Al Shabiba, Omani paper carried 45 articles from 2006 to 2008, and Al Watan newspaper published 25 articles in 2009 and 17 articles in 2010.
  • Published a book on Administrative Research in Omani Laws, Part 3 in 2018.
  • Authored a book on Cases of Nullity in Administrative Decisions Disputes.
  • Writing a Mini Dictionary of legal periods and dates in Omani Laws (in progress).
